These Terms and Conditions govern your use of the iLifeChange website, the iLifeChange Experiment, the MetaMotivations program, the 40-day course, live online sessions, replay access where available, registrations, access links, event reminders, daily materials, digital products, written materials, reflection prompts, forms, communications, support and related services operated by Center for Motivation Research.
In these Terms, “we”, “us” and “our” means Center for Motivation Research, an Australian incorporated non-profit organisation, ABN 84 109 838 718.
By accessing or using our website, registering for the iLifeChange Experiment, participating in the MetaMotivations program, attending a live online session, receiving course access, accessing replays or daily materials where available, purchasing or receiving a related resource, submitting a form, subscribing to updates, or otherwise using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use our website, register for the course, attend live sessions, access streaming or replay links, purchase or access resources, submit forms, access materials, or use our services.
1. Definitions
In these Terms:
“40-Day Course” means the iLifeChange Experiment / MetaMotivations program delivered over a period of approximately 40 days, whether live, online, by replay, by daily materials, or through another delivery format stated by us.
“Booking” means any registration, appointment, call, consultation, event ticket, course enrolment, course seat, access request, or scheduled meeting arranged with us.
“Content” means all text, images, graphics, logos, audio, video, written materials, session resources, reflection prompts, daily experiments, exercises, downloads, frameworks, design elements, software, recordings, replays, livestreams, and other material made available through our Website or Services.
“Course Materials” means any daily practice, reflection prompt, workbook, written material, recording, replay, email, download, worksheet, slide, meditation, exercise, framework, or companion material provided in connection with the iLifeChange Experiment or MetaMotivations program.
“Digital Products” means any online material, downloadable resource, companion material, recording, replay, workbook, reflection prompt, private access page, or other digital content made available by us.
“Event” means any live online session, course session, workshop, webinar, meeting, livestream, replay, campaign, or related online gathering operated by us in connection with the iLifeChange Experiment.
“iLifeChange Experiment” means the 40-day program also known as the MetaMotivations program, delivered through ilifechange.com or related platforms, and designed around daily exercises, reflection, live or replay sessions, and the strengthening of the higher faculties in pursuit of meaningful life change.
“MetaMotivations program” means the iLifeChange Experiment and any related 40-day course, event, digital access, daily course sequence, replay access, or companion material provided under that name or a substantially similar name.
“Registration” means any free or paid registration, purchase, sign-up, reservation, application, form submission, access request, or other process used to receive access to the 40-Day Course, Event, replay, Digital Product, Course Materials, or related Service.
“Services” means our Website, Registrations, Events, live streams, reminders, replays where available, recordings, Digital Products, Course Materials, newsletters, communications, support, forms, resources, and any related services.
“Website” means ilifechange.com and any other website, landing page, platform, or digital property operated by us or used by us in connection with the iLifeChange Experiment or MetaMotivations program.
2. Acceptance of these Terms
You agree to these Terms by:
- accessing or using our Website;
- registering for, purchasing, receiving, or participating in the iLifeChange Experiment;
- registering for, purchasing, receiving, or participating in the MetaMotivations program;
- attending, streaming, viewing, or participating in a live online session, event, or course session;
- accessing a replay, recording, workbook, daily practice, reflection prompt, or other Digital Product;
- purchasing, receiving, or activating access to any related offer, course, consultation, event, or resource;
- submitting any form, enquiry, testimonial, reflection response, event question, chat message, feedback, or support request;
- participating in any online meeting, livestream, call, event, or related communication with us; or
- otherwise using or interacting with our Services.
If you use the Services on behalf of an organisation, company, church, school, community group, institution, partnership, or other entity, you represent that you have authority to bind that entity to these Terms.
3. Changes to these Terms
We may update these Terms from time to time. The updated Terms will apply from the date they are published on our Website, unless otherwise stated.
Your continued use of the Website or Services after updated Terms are published means you accept the updated Terms.
Where reasonably practicable, we may notify users of material changes. It remains your responsibility to review these Terms periodically.
4. Registrations, course access and accounts
Some Services may require Registration, payment, confirmation, access link, calendar link, meeting link, streaming link, replay link, login credential, email confirmation, or platform account.
When you register for the iLifeChange Experiment, submit an enquiry, purchase the 40-Day Course, request replay access, or otherwise use the Services, you may be required to provide personal information such as your name, email address, phone number, organisation name, billing information, role, life-change context, access details, or other relevant information. You must ensure that all information you provide is accurate, current, and complete.
You are responsible for keeping your course links, event links, streaming links, replay links, calendar links, access links, passwords, account credentials, and related details secure. You must not share, sell, transfer, publish, or otherwise make your access credentials available to another person.
You are responsible for all use of your account, Registration, access links, login credentials, course access, replay access, and related details, except to the extent caused by our negligence or breach of law.
We may suspend or terminate access if we reasonably believe that login credentials, course links, replay links, streaming links, or account access have been shared, misused, obtained fraudulently, or used in breach of these Terms.
5. Age requirements
You must be at least 18 years old to register for, purchase, attend, or participate in the iLifeChange Experiment, unless we expressly agree otherwise and you have the consent and supervision of a parent or legal guardian.
If a person under 18 uses our Website or Services, a parent or legal guardian is responsible for supervising that use and ensuring the minor’s use is appropriate.
We do not knowingly permit children under 13 to create accounts, register for Events, or purchase Services.
6. Nature of the iLifeChange Experiment
The iLifeChange Experiment is provided for educational, reflective, formative, motivational, leadership development, self-actualization, philosophical, and practical implementation purposes.
The Services may include live teaching, online course sessions, daily practices, reflective exercises, meditations, written prompts, course questions, chat participation, implementation materials, guided emails, replay access where available, and related materials connected with themes such as motivation, meaning, self-actualization, happiness, ethical formation, the four highest faculties, responsibility, vision, will, imagination, reason, awareness, and meaningful life change.
The iLifeChange Experiment is not a crisis service. It is not intended to diagnose, treat, cure, prevent, or manage any medical, psychiatric, psychological, emotional, relational, financial, legal, or other condition.
Participation is voluntary. You are responsible for deciding whether the iLifeChange Experiment, its ideas, its questions, its exercises, its daily practices, its meditations, its implementation materials, and its practical recommendations are appropriate for you, your organisation, and your circumstances.
7. No emergency or crisis service
Our Services are not an emergency, crisis, suicide prevention, domestic violence, medical, psychiatric, or urgent mental health service.
We do not monitor enquiries, emails, forms, registrations, event chats, support messages, or platform messages continuously and cannot guarantee an immediate response.
If you are experiencing a medical emergency, mental health crisis, risk of harm to yourself or another person, severe distress, violence, abuse, or urgent personal difficulty, you should contact emergency services or an appropriate qualified professional in your location immediately.

8. No professional advice
Our Content and Services are not medical, psychological, psychiatric, counselling, therapeutic, legal, financial, taxation, investment, crisis, or emergency advice.
Unless expressly agreed in writing, the iLifeChange Experiment is not a substitute for professional diagnosis, clinical treatment, psychotherapy, psychiatric care, legal advice, financial advice, accounting advice, workplace investigation, human resources advice, pastoral care, counselling, therapy, or emergency assistance.
Although the Services may discuss motivation, happiness, self-actualization, meaning, spirituality, suffering, desire, responsibility, habits, life direction, work, relationships, decision-making, leadership, discipline, daily practice, and the pursuit of the good, we do not promise or guarantee any particular emotional, psychological, spiritual, financial, relational, educational, organisational, behavioural, leadership, health, income, business, or commercial outcome.
You should seek appropriate professional advice before making decisions that may have significant legal, financial, medical, employment, organisational, business, relational, spiritual, physical, or personal consequences.
9. Suitability, availability and course changes
The iLifeChange Experiment is designed for serious self-directed participants who wish to engage in a 40-day course of reflection, motivation, daily practice, philosophical formation, and meaningful life change.
We may decline, restrict, or cancel Registration, access, participation, replay access, or related Services if we believe the Services are not suitable for your circumstances, needs, behaviour, expectations, risk profile, or intended use.
We may change, reschedule, postpone, cancel, rename, restructure, extend, shorten, or replace a course, Event, session, speaker, topic, format, platform, replay, access period, daily material, course resource, or related offer where reasonably necessary.
We will take reasonable steps to communicate material changes to registrants where practicable, but we are not responsible for notices you miss because of incorrect details, spam filters, email settings, platform issues, device issues, or failure to check your inbox.
10. 40-day course delivery and participation
The iLifeChange Experiment is generally structured as a 40-day course or incubation process. It may be delivered live, online, by replay, by daily course materials, by email, through private access pages, by video conferencing technology, through a member or event platform, or through another format stated by us.
The course may be delivered over approximately six weeks or another stated period, depending on the live event schedule, access period, replay availability, course calendar, or delivery structure in place at the time.
Participation may involve daily practices, reflective exercises, meditations, written prompts, course videos, live sessions, replay viewing, group participation, and personal implementation. The amount of time required may vary by participant and by the course structure in place.
You are responsible for checking your email, calendar, access pages, course platform, or other communication channels for course instructions, event details, live session links, replay details, daily materials, and access updates.
You are responsible for participating at your own pace and discretion, and for deciding how to apply the course materials in your own life, leadership, family, work, spiritual, educational, or organisational context.
11. Live sessions, streaming, recordings and replays
The iLifeChange Experiment may include live online sessions, course sessions, workshops, webinars, meetings, livestreams, recordings, replays, group discussions, chat features, questions, comments, or other interactive features.
You are responsible for ensuring that your internet connection, device, browser, audio, video, email access, calendar access, software, and physical environment are suitable for participating in the course.
We do not guarantee that livestreams, meeting platforms, webinar platforms, video platforms, payment platforms, form platforms, calendar tools, or third-party services will be uninterrupted, error-free, compatible with your device, or available at all times.
We may record live online sessions, workshops, webinars, meetings, streamed sessions, or related broadcasts.
If you choose to appear on camera, speak, ask a question, post in chat, submit comments, participate in discussion, or otherwise contribute to an Event, your name, image, voice, comments, questions, or other participation may be captured in a recording or replay.
Replay access, recordings, slides, transcripts, notes, workbooks, and post-session materials may not always be available. Where replays or materials are available, access may be subject to Registration status, purchase status, access period, platform availability, technical limitations, and any applicable terms.
You must not record, screenshot, copy, download, reproduce, publish, redistribute, livestream, transmit, sell, share, or make available any iLifeChange session, livestream, replay, recording, course access link, slide, workbook, transcript, daily material, private communication, or related resource without our prior written permission.
12. Daily practices, personal responsibility and implementation
The iLifeChange Experiment may include daily experiments, reflective practices, meditations, written exercises, self-observation, journaling, values work, faculty exercises, personal reflection, and implementation steps.
You remain responsible for your own choices, conduct, safety, duties, relationships, legal obligations, financial decisions, health decisions, spiritual decisions, organisational decisions, and practical implementation before, during, and after the course.
You should not undertake any physical, medical, psychological, fasting, dietary, relational, financial, spiritual, legal, organisational, or high-risk activity connected with the course without making your own careful assessment and, where appropriate, obtaining qualified professional advice.
If a course exercise, reflection, meditation, or suggested practice is not suitable for you, you are responsible for pausing, modifying, declining, or seeking appropriate advice before continuing.
The course is intended to support meaningful reflection and formation. It is not a guarantee that a particular habit, emotional state, relationship, business result, spiritual result, health result, or life outcome will occur.
13. Digital access and materials
When you register for, purchase, or receive access to iLifeChange resources, replays, recordings, written materials, event materials, daily practices, reflection prompts, downloads, workbooks, guided emails, or any Digital Product, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the materials for your own personal, private, non-commercial use only, subject to these Terms.
This licence does not transfer ownership of any Content, Digital Product, recording, workbook, exercise, prompt, design, idea, method, framework, daily practice, course structure, or intellectual property right to you.
Unless expressly authorised by us in writing, you must not:
- copy, download, rip, record, reproduce, duplicate, broadcast, livestream, transmit, publish, upload, distribute, share, sell, resell, sublicense, or otherwise exploit the Services or any part of them;
- share your login details, access link, event link, replay link, calendar link, meeting link, password, account, or private materials with any other person;
- screen, show, display, exhibit, perform, or make available the Services, recordings, replays, notes, prompts, daily practices, course materials, or resources to any group, class, audience, organisation, institution, business, school, university, church, community group, retreat, coaching group, leadership group, or public audience without our prior written permission;
- use the Services or Content for commercial purposes, paid events, training programs, educational programs, workplace programs, professional programs, retreats, seminars, or conferences without our prior written permission;
- edit, alter, remix, translate, adapt, subtitle, repackage, or create derivative works from the Services or related Content;
- use the Services or Content for artificial intelligence training, machine learning, scraping, dataset creation, automated analysis, or data mining; or
- circumvent, disable, interfere with, or attempt to bypass any access control, platform restriction, or security measure.
14. Prices, payments and taxes
Prices, course fees, event fees, replay fees, digital product fees, related offer fees, and payment terms may be displayed on a checkout page, stated in writing, included on an offer page, or otherwise communicated before payment is completed.
You are responsible for reviewing the price, currency, access period, course description, service description, inclusions, exclusions, payment terms, cancellation terms, guarantee terms, and purchase terms before completing payment or confirming an engagement.
Payments may be processed by third-party payment providers. We do not control all aspects of third-party payment processing and are not responsible for delays, errors, declines, fees, exchange rates, chargebacks, or other issues caused by your bank, card issuer, payment provider, or third-party platform, except where required by law.
You are responsible for any applicable taxes, duties, currency conversion fees, bank fees, or other charges that may apply to your purchase.
15. Cancellations, refunds, guarantees and Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, warranty, condition, or other right that cannot lawfully be excluded, restricted, or modified.
Where a satisfaction guarantee is expressly stated on the relevant offer page, checkout page, course page, or written offer, that guarantee applies only according to the terms, dates, requirements, access conditions, and limitations stated for that offer.
If the offer states that satisfaction is guaranteed for a specified period after the program starts, any request under that guarantee must be made within that stated period and must include sufficient information for us to identify your Registration, purchase, course access, and the relevant offer.
To the extent permitted by law, and except where an express written guarantee applies, we do not offer refunds for change of mind, failure to attend live sessions, failure to watch replays during an access period, failure to complete the 40-Day Course, failure to complete daily practices, failure to use access during an access period, or dissatisfaction where the Service has been provided as described and is not faulty.
If a Service is faulty, not supplied as described, inaccessible due to an issue within our reasonable control, or otherwise fails to meet a consumer guarantee, you may be entitled to a remedy under Australian Consumer Law.
If you experience a technical access issue, you should contact us within a reasonable time and provide sufficient details for us to investigate, including the details used to register or purchase, date of registration or purchase, relevant course or Service, device/browser used, and a description of the issue.
Where permitted by law, our liability for a failure to comply with a consumer guarantee may be limited to resupplying the relevant service or paying the cost of resupplying the relevant service.
16. User submissions, reflections and event contributions
If you submit information, ideas, proposals, messages, enquiries, testimonials, feedback, reflection responses, life-change context, leadership context, personal context, questions, chat messages, comments, or other material to us, you warrant that:
- you have the right to submit that material;
- the material is accurate to the best of your knowledge;
- the material does not infringe any third-party rights;
- the material is not unlawful, defamatory, misleading, confidential without authority, offensive, obscene, threatening, discriminatory, or otherwise inappropriate; and
- you are not submitting the material for an unlawful or unauthorised purpose.
You grant us permission to use, store, review, copy, respond to, moderate, publish, display, quote, paraphrase, refer to, and internally share your submission for the purpose of assessing, responding to, administering, supporting, improving, or acting on your enquiry, Registration, course participation, service access, or relationship with us.
If you submit a question, comment, chat message, testimonial, feedback, or contribution during an Event, you acknowledge that it may be seen, heard, used, responded to, referred to, or captured in a recording or replay.
Unless we expressly agree in writing, you should not submit trade secrets, highly confidential business information, unpublished creative concepts, sensitive personal information, or third-party confidential information through general website forms, event chats, questions, booking forms, or email enquiries.
Submitting an idea, proposal, reflection, question, testimonial, comment, or enquiry does not give you any ownership right, payment right, approval right, partnership right, or claim over any existing or future work, project, product, course, campaign, Event, service, or business activity of ours.
17. Acceptable use
You must not use our Website, Content, Registrations, Events, livestreams, replays, Digital Products, Course Materials, forms, platforms, or Services in any way that is unlawful, harmful, misleading, abusive, unauthorised, or inconsistent with these Terms.
You must not:
- breach the privacy, intellectual property, contractual, moral, publicity, confidentiality, or other rights of any person;
- upload, transmit, or distribute viruses, malware, worms, Trojan horses, spyware, malicious code, or harmful material;
- attempt to gain unauthorised access to our systems, accounts, platforms, content, payment systems, forms, servers, databases, course platforms, replay pages, or networks;
- interfere with, disrupt, damage, overload, scrape, crawl, copy, reverse engineer, or attempt to bypass the operation or security of our Website or Services;
- use our Content or Services to defame, harass, threaten, abuse, mislead, impersonate, or unlawfully target any person;
- post or transmit material that is defamatory, obscene, pornographic, racist, discriminatory, threatening, abusive, unlawful, or otherwise inappropriate;
- share, sell, publish, transfer, or misuse course access links, replay links, calendar links, login credentials, or private access pages;
- use automated tools, bots, scrapers, crawlers, data-mining tools, or artificial intelligence systems to collect, copy, analyse, train on, or extract Content without our prior written permission;
- use our Website, Content, Digital Products, Events, replays, recordings, Course Materials, or Services for any commercial purpose not expressly authorised by us; or
- misrepresent your identity, affiliation, authority, organisation, intentions, or relationship with us.
If we allow you to post, upload, submit, chat, comment, message, or transmit information through our Website, platforms, Events, forms, or Services, we may remove, moderate, refuse, restrict, or disable access to that material at our discretion.
18. Intellectual property
Unless otherwise indicated, we own or license all rights, title, and interest, including copyright, trade marks, designs, moral rights, confidential information, and other intellectual property rights, in the Website, Content, iLifeChange materials, MetaMotivations materials, live sessions, recordings, replays, workbooks, reflection prompts, daily practices, exercises, frameworks, event materials, Digital Products, branding, design, software, and Services.
Your use of our Website, Content, iLifeChange materials, MetaMotivations materials, Digital Products, Course Materials, or Services does not transfer any intellectual property rights to you.
Except as expressly permitted by these Terms, by law, or by our prior written permission, you must not copy, reproduce, download, distribute, publish, display, perform, communicate, modify, adapt, translate, create derivative works from, sell, license, exploit, or commercially use any part of our Content, Digital Products, recordings, replays, workbooks, daily practices, event materials, or Services.
All rights not expressly granted are reserved.
19. Personal and non-commercial use
Unless we expressly agree otherwise in writing, our Website, Content, course access, livestreams, replays, iLifeChange access, MetaMotivations access, Course Materials, Digital Products, and Services are provided for personal, private, non-commercial use only.
You must not use the iLifeChange Experiment, MetaMotivations program, Content, Digital Products, recordings, replays, workbooks, prompts, exercises, daily practices, course methods, or Services for advertising, commercial training, revenue generation, paid events, organisational programs, institutional use, educational delivery, public performance, commercial promotion, or other commercial purposes without our prior written permission or a separate written agreement.
20. Third-party platforms, services and links
Our Website and Services may use, link to, embed, or integrate with third-party services, including booking platforms, payment processors, video meeting platforms, webinar platforms, streaming platforms, replay platforms, email platforms, form providers, analytics providers, course platforms, membership platforms, hosting providers, social media platforms, calendar providers, and other technology suppliers.
We may also link to websites operated by third parties.
Third-party websites, platforms, tools, and services are not controlled by us. We are not responsible for their content, availability, security, privacy practices, terms, policies, fees, errors, downtime, or actions.
Your use of third-party platforms or services may be subject to their own terms and policies.
We provide third-party links and integrations for convenience and functionality. Unless expressly stated, a link or integration does not imply endorsement, sponsorship, or approval.
21. Privacy and collection notice
We collect personal information in order to provide and administer our Website, Registrations, Events, the 40-Day Course, live streams, replays where available, enquiries, contact forms, newsletters, purchases, access credentials, Course Materials, support, and related Services.
The personal information we collect may include your name, email address, phone number, billing details, organisation details, role, enquiry details, registration details, purchase history, account information, form responses, course participation details, chat messages, questions, reflection responses, technical information, and communications with us.
We may collect personal information through website forms, WPForms, booking forms, checkout pages, newsletter forms, registration forms, reflection forms, analytics tools, embedded video or meeting services, webinar platforms, streaming platforms, payment processors, email marketing systems, calendar platforms, and other service providers.
We may disclose personal information to third parties who help us operate our Website and provide our Services, including technology providers, payment processors, communication providers, form providers, hosting providers, analytics providers, professional advisers, contractors, booking platforms, streaming platforms, course platforms, member platforms, and where required or authorised by law.
Some third-party providers may store or process information outside Australia.
If you do not provide requested personal information, we may not be able to provide all Website access, Registrations, course access, streaming access, replay access, daily material access, support, communications, or related Services to you.
Our Privacy Policy explains how we collect, use, disclose, store, protect, access, correct, and handle complaints about personal information. By providing personal information to us, you consent to our collection, use, storage, and disclosure of that information in accordance with these Terms and our Privacy Policy.
22. Direct marketing and communications
If you subscribe, register, purchase, book a call, submit a form, download materials, attend a course session, access a replay, or otherwise engage with us, we may send you transactional, service-related, administrative, reminder, and, where permitted, marketing communications.
Marketing communications may include information about the iLifeChange Experiment, MetaMotivations program, Center for Motivation Research, related events, masterclasses, products, resources, campaigns, course materials, or services.
You may unsubscribe from marketing communications using the unsubscribe link provided in those communications, where applicable.
We may still send you non-marketing communications where required or reasonably necessary, including registration confirmations, event reminders, access instructions, replay notices, purchase confirmations, support replies, legal notices, service updates, account notices, and administrative messages.
23. Promotions, bonuses and limited offers
From time to time, we may offer bonuses, discounts, limited-time offers, promotional access, replay access, companion resources, guided email sequences, related consultations, or other promotional benefits.
Promotional offers may be subject to eligibility requirements, availability, access periods, platform restrictions, payment requirements, time limits, course attendance requirements, onboarding requirements, or other conditions stated at the time of the offer.
We may modify, withdraw, replace, or end a promotion, bonus, limited offer, or access benefit where reasonably necessary, subject to applicable law.
Unless expressly stated otherwise, promotional benefits have no cash value, are non-transferable, cannot be exchanged for other products or services, and may not be available after the relevant access period or offer period ends.
24. Website security and technical risks
We do not guarantee that our Website, platforms, downloads, embedded content, registration pages, booking platforms, meeting platforms, webinar platforms, streaming platforms, replay platforms, payment systems, member portals, course platforms, or third-party services will be uninterrupted, secure, error-free, compatible, or free from viruses or harmful components.
You are responsible for taking your own precautions to ensure that your devices, systems, browsers, accounts, passwords, meeting spaces, and internet connections are secure and protected.
We are not responsible for loss or damage caused by viruses, malware, cyber incidents, platform outages, streaming failures, third-party service failures, user error, compromised accounts, unauthorised recording by another party, or unauthorised access outside our reasonable control, except where required by law.
25. Suspension and termination
We may restrict, suspend, or terminate your access to our Website, Content, Digital Products, Registrations, Events, livestreams, replays, recordings, Course Materials, accounts, forms, or Services if we reasonably believe that you have breached these Terms, misused access, infringed our rights, engaged in unlawful conduct, shared access credentials, made unauthorised public or commercial use of the Services, behaved abusively, or otherwise acted in a way that may harm us, our users, our partners, our platforms, or our rights.
We may also suspend or withdraw a Website, feature, Digital Product, Event, replay, recording, resource, Registration, platform, or Service where reasonably necessary for maintenance, security, legal, technical, professional, commercial, platform, rights, or operational reasons.
Termination or suspension does not affect any rights or obligations accrued before termination, including payment obligations, intellectual property obligations, confidentiality obligations, course obligations, access obligations, or liability for breach.
26. Warranties and disclaimers
To the maximum extent permitted by law, and subject to any non-excludable rights under Australian Consumer Law, we make no warranties or representations that:

- any particular outcome, result, transformation, emotional change, personal change, spiritual result, motivational result, self-actualization result, ethical formation result, leadership result, organisational result, business result, income result, or financial result will occur;
- the Website, Content, iLifeChange Experiment, MetaMotivations program, Digital Products, Registrations, Events, replays, or Services will meet your personal expectations, preferences, circumstances, technical environment, or intended use; or
- third-party platforms, payment systems, video platforms, webinar platforms, streaming platforms, booking platforms, meeting platforms, form providers, member portals, course platforms, or hosting providers will always operate without interruption.
27. Limitation of liability
Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, condition, or liability that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, punitive, or economic loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, loss of data, business interruption, emotional distress, reputational harm, or other loss arising from or connected with your use of, participation in, or inability to use our Website, Content, iLifeChange Experiment, MetaMotivations program, Digital Products, Registrations, Events, livestreams, replays, recordings, Course Materials, or other Services.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Services is limited to the amount you paid us for the relevant product, course, event, package, or service giving rise to the claim.
Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of resupplying the relevant service.
28. Indemnity
To the maximum extent permitted by law, you agree to indemnify us, our officers, employees, contractors, volunteers, agents, licensors, partners, and service providers against any loss, damage, cost, expense, claim, demand, liability, or proceeding arising from or connected with:
- your breach of these Terms;
- your misuse of the Website, iLifeChange Experiment, MetaMotivations program, Content, Digital Products, course materials, recordings, replays, access links, meeting links, streaming links, replay links, or Services;
- your unauthorised copying, sharing, distribution, public use, commercial use, or exploitation of the Services or Content;
- your infringement of our intellectual property rights or the rights of any third party;
- your unlawful, misleading, defamatory, harmful, abusive, disruptive, or unauthorised conduct;
- your submissions, enquiries, proposals, uploads, statements, reflections, questions, chat messages, comments, or representations to us or to third parties; or
- your breach of any Registration, purchase, event, course, access, partnership, affiliate, or other separate agreement with us.
29. Force majeure
We are not liable for delay or failure to perform an obligation where the delay or failure is caused by events beyond our reasonable control.
This may include acts of God, natural disasters, power failures, internet failures, cyber incidents, platform outages, third-party provider failures, streaming failures, webinar failures, strikes, pandemics, government action, legal restrictions, war, terrorism, civil unrest, equipment failure, illness, family emergency, venue issues, speaker unavailability, or other events outside our reasonable control.
30. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be severed to the extent necessary, and the remaining parts will continue in full force and effect.
31. No waiver
If we do not exercise or enforce a right under these Terms, that does not mean we waive that right.
A waiver must be in writing and signed by us.
32. Assignment
You must not assign, transfer, sublicense, or otherwise deal with your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights or obligations where reasonably necessary in connection with a restructure, change of platform, service provider arrangement, transfer of rights, merger, acquisition, or other organisational change, provided this does not reduce any non-excludable rights you have under law.
33. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia.
